Chlidren's Claims

You can claim on behalf of your child

If your child has been involved in an accident that was not their fault, they can make a claim. However in the eyes of the law, under 18 year olds are not capable of managing their own affairs.

A 'litigation friend' must be appointed to manage the claim on their behalf. This can be anybody over the age of 18, but is preferably a parent or guardian.

The court must approve the compensation amount to ensure that the child will be properly compensated. The court will not approve any award that they feel is too low.

When the claim settles, the money will be placed into the court funds office until the child reaches the age of 18. The court funds office will ensure that the funds are in a high interest rate account until then.

The court may release some of the funds prior to your child reaching 18, but this will only be in exceptional circumstances such as for educational purposes.

 

Criminal Assault

Claims for criminal assault are run though the Criminal Injuries Compensation Authority who will review your claim and compensate you accordingly.

CICA claims generally follow a different set of rules to other personal injury claims, in that you can only claim for loss of earnings if your injury has prevented you from working for 28 weeks or longer.

Needlstick Injuries

The time following a needlestick injury is a very difficult one for our clients.
