Frequently Asked Questions
I'm not sure if I have a claim...
If you've been injured in an accident that was not your fault, you are legally entitled to claim compensation for your injuries and other losses incurred as a result of that accident. If you aren't sure if you have a claim, contact us or fill in the claim form on the right, and we can help you.
How much compensation will I receive?
Every case is different, but you can take our online test to get an estimated amount
When working out how much you should receive, the most important factors are how serious your injuries are, and how long you have suffered with them. You can also claim for any losses you have incurred as a result of the accident, including loss of earnings, travel expenses, prescription charges, damaged clothing and property, costs of postage and telephone calls and care and assistance.
What does no win, no fee, no risk mean?
All of our claims are run on a no win, no fee basis and when you win, in most cases our costs are recovered from the other side
Criminal assault claims, and medical negligence claims are run slightly differently. They are still no win no fee, but because we cannot recover our costs from the other side, we subtract them from your award.
We will always go through the details of your claim before proceeding, and you are under no obligation.
What happens when I fill in the form?
A member of our team will be in touch to discuss your claim and answer any questions you have. You are under no obligation, but if you decide to go ahead, we can take care of your claim from start to finish.
Will I have to pay anything?
No - We won't ask you for any money, and in most cases you receive all of your compensation.
All of our claims are dealt with on a no win no fee basis, however other costs may be payable.
Your solicitor will advise you on your individual case.
Will I need to go to court?
It's very unlikely that you will need to go to court as most cases settle a long time before this.
Is there a time limit for my claim?
The usual limitation period for a claim is three years, however different rules can apply for accidents abroad, and claims for children. For clinical negligence claims, the limit is three years from the date you realised you were injured.
If you think you are out of time, get in touch anyway as we may be able to help.
I don't remember the exact accident date
Don't worry, if you attended your GP or the accident and emergency department, they will have a record of the date. Your solicitor can obtain this for you.
If your accident was at work or in a shop, you will probably have completed an accident report book, which will contain the accident date. Your solicitor will obtain a copy of this for you.
Will I need to visit a solicitor?
No - We aim to provide a completely hassle-free service and most claims can be dealt with over the phone. If you'd prefer to deal with us face to face you are welcome to come to our office, or we can arrange to come to you.
My insurance company says I need to use their solicitor, is that right?
No, you have the freedom to choose any solicitor you wish and as long as you haven't accepted a settlement offer, you can move elsewhere.
There weren't any witnesses, does that matter?
This depends on the details of your claim, but witnesses aren't always essential to make a successful claim. If you do have witnesses, try to get their names and addresses.
I didn't think I was injured at the time, can I still claim?
Yes - your symptoms may not be apparent until a while after the accident, and you can make a claim then.
I don't want to claim against my employer, friends or family, what can I do?
By law, employers need to have employer's liability insurance which covers them for claims made against them.
If you were a passenger in a car driven by a friend or family member that caused an accident, so long as they have motor insurance, their insurance company will pay your compensation, and not them.
The other driver didn't stop, can I claim?
Yes, your claim can be made through the Motor Insurers Bureau (MIB). The MIB is a government body that was set up to compensate victims of accidents involving uninsured or untraced drivers.
Easy2Claim will make this process straightforward and hassle-free for you.
I didn't take any time off work, will this affect my claim?
Many people are self employed or do not get paid for sick days from work and therefore cannot afford to take time off. You can still make a claim, regardless of whether you had time off or not.
Sometimes, it's not necessary to take time off, for example, if you work in an office, you may not need to take time off work for a whiplash injury.
I don't have a physical injury, can I still claim?
Many people aren't physically injured, but can be affected psychologically. These type of injuries can include (but not limited to) depression, travel anxiety, driver anxiety, nightmares, flashbacks and post traumatic stress disorder.
These injuries are taken extremely seriously, and are compensated accordingly.
I wasn't wearing a seat belt / helmet, will I still get compensation?
This depends on your individual circumstances. However, if your injuries were worse as a direct result of you not wearing a seat belt or helmet, you may receive a reduced amount.
